These Terms of Use ("Terms") govern access to and use of Ritnome, a rhythm-driven, reaction-based physical education platform ("Ritnome" or the "Service") provided by Gostar Digital LLC ("Gostar Digital," "we," "us," or "our"). By accessing or using Ritnome, you agree to these Terms on behalf of yourself and, if applicable, the school or organization you represent.

1. License Grant

Subject to these Terms and payment of any applicable fees, Gostar Digital grants your school or organization a limited, non-exclusive, non-transferable license to access and use Ritnome using the access code issued to you, for the duration of your active license term. This license does not include the right to resell, sublicense, or redistribute Ritnome or any access code.

2. Acceptable Use

You agree not to:

• Share your school's access code with any party outside your licensed institution;
• Copy, modify, decompile, reverse-engineer, or create derivative works based on Ritnome;
• Scrape, extract, or redistribute Ritnome's code, content, or assets;
• Use Ritnome for any purpose other than physical education and reaction-based activity within your licensed institution;
• Interfere with or disrupt the integrity or performance of the Service.

3. Intellectual Property

Ritnome, including its name, branding, game mechanics, code, design, and all associated content, is the property of Gostar Digital LLC and is protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of any Gostar Digital intellectual property to you.

4. No Student Accounts

Ritnome does not require individual student accounts. Access is granted at the institutional level via a school-issued access code, consistent with our Privacy Policy.

5. Service Availability

We aim to keep Ritnome available and performing well, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features of the Service at any time.

6. Disclaimer of Warranties

Ritnome is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Limitation of Liability

To the fullest extent permitted by law, Gostar Digital LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of, or inability to use, Ritnome.

8. Termination

We may suspend or terminate access to Ritnome for any account or institution found to be in violation of these Terms, or upon expiration or non-renewal of a license term.

9. Governing Law

These Terms are governed by the laws of the Commonwealth of Puerto Rico, without regard to its conflict-of-law principles.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date at the top of this page. Continued use of Ritnome after changes take effect constitutes acceptance of the revised Terms.

Estos Términos de Uso ("Términos") rigen el acceso y uso de Ritnome, una plataforma de educación física basada en reacción y ritmo ("Ritnome" o el "Servicio") provista por Gostar Digital LLC ("Gostar Digital," "nosotros" o "nuestro"). Al acceder o usar Ritnome, usted acepta estos Términos en su propio nombre y, si corresponde, en nombre de la escuela u organización que representa.

1. Otorgamiento de Licencia

Sujeto a estos Términos y al pago de las tarifas aplicables, Gostar Digital otorga a su escuela u organización una licencia limitada, no exclusiva e intransferible para acceder y usar Ritnome utilizando el código de acceso que se le ha emitido, durante la vigencia de su licencia activa. Esta licencia no incluye el derecho de revender, sublicenciar o redistribuir Ritnome o cualquier código de acceso.

2. Uso Aceptable

Usted se compromete a no:

• Compartir el código de acceso de su escuela con cualquier parte fuera de su institución licenciada;
• Copiar, modificar, descompilar, aplicar ingeniería inversa o crear trabajos derivados basados en Ritnome;
• Extraer o redistribuir el código, contenido o recursos de Ritnome;
• Usar Ritnome para cualquier propósito que no sea educación física y actividad basada en reacción dentro de su institución licenciada;
• Interferir con o interrumpir la integridad o el rendimiento del Servicio.

3. Propiedad Intelectual

Ritnome, incluyendo su nombre, marca, mecánicas de juego, código, diseño y todo el contenido asociado, es propiedad de Gostar Digital LLC y está protegido por las leyes de propiedad intelectual aplicables. Nada en estos Términos transfiere la propiedad de ninguna propiedad intelectual de Gostar Digital a usted.

4. Sin Cuentas de Estudiantes

Ritnome no requiere cuentas individuales de estudiantes. El acceso se otorga a nivel institucional mediante un código de acceso emitido por la escuela, conforme a nuestra Política de Privacidad.

5. Disponibilidad del Servicio

Nuestro objetivo es mantener Ritnome disponible y funcionando correctamente, pero no garantizamos un funcionamiento ininterrumpido o libre de errores. Podemos modificar, suspender o descontinuar funciones del Servicio en cualquier momento.

6. Renuncia de Garantías

Ritnome se proporciona "tal cual" y "según disponibilidad," sin garantías de ningún tipo, ya sean expresas o implícitas, incluyendo, entre otras, garantías de comerciabilidad, idoneidad para un propósito particular o no infracción.

7. Limitación de Responsabilidad

En la máxima medida permitida por la ley, Gostar Digital LLC no será responsable de daños indirectos, incidentales, especiales o consecuentes que surjan de o estén relacionados con su uso, o incapacidad de uso, de Ritnome.

8. Terminación

Podemos suspender o terminar el acceso a Ritnome para cualquier cuenta o institución que se determine que está en violación de estos Términos, o al vencimiento o no renovación de un período de licencia.

9. Ley Aplicable

Estos Términos se rigen por las leyes del Estado Libre Asociado de Puerto Rico, sin considerar sus principios de conflicto de leyes.

10. Cambios a Estos Términos

Podemos actualizar estos Términos periódicamente. Los cambios importantes se reflejarán con una fecha de "Última actualización" renovada en la parte superior de esta página. El uso continuo de Ritnome después de que los cambios entren en vigor constituye la aceptación de los Términos revisados.
